This indenture made & entered into this the seventh day of September in the year of our Lord Eighteen Hundred & thirty-nine Between Hempley Hurt, John Hurt, Hardin Hurt, Jesse Carter, Jinsey Carter, Thomas Johnson, Susannah Johnson, Daniel Collie and Sally Collie, Heirs of Joel Hurt Deceased of the one part and Harman H. Hurt of the other part all being of the county Henderson & State of Tennessee. Witnesseth that the above named heirs on their part for and in consideration of the sum of three Hundred Dollars in hand paid, the Receipt whereof is hereby acknowledged, hath Bargained, sold…& confirmed unto the said Harman H. Hurt all and severally and each of us all our Right, Title, Claim & interest in & to the following Described parcel or tract of Land lying and situate in the county and state above named bounded as follows (viz) Situate in the 9th Surveyors district on Jacks Creek Range 4 Section 7 and Beginning on a poplar 40 poles South of the North East corner of entry No. 1430 for 35 Acres in the name of Madison Gilcrist thence East 40 poles to a stake thence north 127 poles to a sweet gum and poplar on the south boundary line of Entry no 314 for 200 Acres Thence West with sd line crossing Jack Creek at eight poles in all 60 poles to a white oak the north East corner of John Purdys Entry no 1557 for 15 Acres thence South with sd line to the South East corner of the same 35 poles to a holly thence west with said line 34 1/2 poles to a Dogwood & hickory Thence South 52 poles to a hickory on the North boundary line of Entry no 1430 thence East 54 1/2 poles to its corner thence south 40 poles to the beginning containing 50 Acres and 130 poles And also one other tract or parcel of land being in the state and county aforesaid situate in the 9th Surveyors district on the Waters of Jack Creek Range 4 Section 7th and bounded as follows Beginning on a black oak & hickory 35 poles north and 20 poles east of the north East corner of John Greer’s entry no 717 for 243 3/4 Acres thence East 80 poles to a black oak thence north 70 poles to a stake thence west 80 poles to a black gum and hickory thence south 70 poles to the beginning containing 35 Acres To have & to hold the above recited tracts or parcels of land with all the appertenances thereto belonging to the sd Harmon H. Hurt his heirs & assigns for ever And we the above named heirs for ourselves and our Executors, Administrators or Assigns do covenant and agree to and with the said H. H. Hurt his heirs, executors, administrators or Assigns the above recited lands & Bargained premises and the Appertainences. we will warrant and defend right, title, claim and interest or demand of all and every other person or persons whatever in testimony where of we have here unto set our hands & seals the day and date above written.

We the Undersigned Heirs and Children of Elizabeth Woodson do Jointly and Severally agree to gave unto the said Elizabeth Woodson Two Negroes Viz. Peter and Alex/Alec free from the Claim of us or Our heirs to do as she pleases with forever. As Given under Our hands and Seals this 8th April 1822.

Lucy Hurt widow of West Dandridge Hurt made satisfactory proof to this Court that she has settled on one hundred acres of unappropriated land in this County and made satisfactory proof to the Court that she has not estate in her own right to the value of $100 by two credible witnesses this is ordered to be certified to the auditor. (Then it listed:) Present – John Taylor, John Gray, Joseph C. Frazier, Robert Coleman, Henry C. Ewing & Robert Ellis, Esq.)

Hurt be and he is hereby appointed Surveyor of that part of the Road leading from Greenville to Elkton formmering at Shoulders old place and continuing to a post oak opposite the head of a hollow where the old road intersects with new on the North side of Dempsey Cornwell old place. Ordered that all the hands in the following bonds assist him in keeping the Same in repair clear & smooth according to law. Hurt by his attorney appeared in Court and objected to the writing purporting to be the last will & Testament of sd. Hurt de. Being recorded and this cause is continued until the 19th of this month for further litigation.

On the motion of William s. Pace Administrator of the Will annexed of Moses Hurt decesed (sic). It is ordered that Noel Pepper, F. M. Pepper, and J. J. Griffin be and they are hereby appointed appraisers of the personal estate of Moses Hurt decesed any Two of whom may act after being first duly sworn and that they make their Report to this Court.

This day came the parties aforesaid and with leave of the Court the contestant of said will R. F. Hurt with drew his defince, and the propunders moved the Court to have said will probated and the writing purporting to be the last will and Testament of said Moses Hurt was again produced in Open Court and proven by the oaths of E. G. Hale and Abraham Allerson two of the subscribing witnesses to be the act and deed of said Moses Hurt decesed and ordered to be recorded.

On the motion of W. S. Pace he is hereby appointed administrator with the will annexed of Moses Hurt decesed, Thereupon the said Pace took the oath required by Law and together with Noel Pepper and John G. Hurt his Securities entered into an acknowledged bond to the Commonwealth of Kentucky conditioned according to Law.

On the motion of W. S. Pace he is hereby appointed Guardian for his infant children to wit Moses E. Hurt, James A. Hurt, Margaret I./J. Hurt, W. F. Hurt and Emily I./J. Hurt infant under the age of Fourteen year, Thereupon the said W. S. Pace took the oath required by Law and together John G. Hurt his Security entered into bond to the Commonwealth of Kentucky conditioned according to Law.

This day came John G. Hurt and filed his notice and moved the court to be released as one of the security of W. S. Pace as Guardian for his children and It appearing to the satisfaction of the Court that said Pace has been duly notified of this intended motion and failing to answer It is ordered that said Pace be and he is required to execute a new bond as Guardian for his sd. Children on the next term of this court and on failing to do he will be removed as Guardian.

On 22 Feb 1865, Frances A. Hurt & Job Calvin leased to W. H. Howe, J. F. Hayden, and E. G. Hale 200 acres known as the Bailey Place on Forbeses Creek, 10 miles northeast of Hopkinsville, KY. It was a 20 year mineral lease whereby they might mine or rig for oil, salt water, coal iron with the Hurt/Calvin to get 1/25 of the minerals or proceeds and exploration was to begin for the minerals within 5 years. Witnessed by Noel W. Spurlin, M. N. Miller. Signed F. A. Hurt, Job (his X mark) Calvin, W. H. Howe, J. F. Hayden, E. G. Hale. Recorded 6 March 1865.

On 16 Aug 1866, Wm. Lacy and wife Julia of Todd Co., KY. Sold to F. A. Hurt, no wife listed, of Christian Co., KY, for $100.00, 100 acres on headwaters of Little River. Recorded 7 Dec 1866.

On 8 Dec 1866, F. A. Hurt & wife, Nancy C. Hurt, of Christian County, KY sold to Ruth C. Drake, wife of E. L. Drake, of Christian County, KY. The land for $160.00. Signed by F. A. Hurt and Nancy C. (her X mark) Hurt. Recorded 8 Dec 1866.

This Indenture made this 3rd day of August 1867 between G. W. Hardiman of the County of Webster and State of Kentucky of the one part & Nancy C. Hurt of the County of Christian and State aforesaid of the other part Witnesseth, that the Said G. W. Hardiman for and in consideration of the Sum of Four hundred Dollars to him in hand paid by the Said Hurt the receipt of which is hereby acknowledged hat bargained and Sold and by these presents doth grant bargain and Sell to the Said Nancy C. Hurt her heirs forever a certain tract or parcle of land lying and being in the County of Christian on the McFarland fork of Pond river it being part of the Survey Known as the Davice Survey containing 100 acres and bounded as follows: Beginning at a Small maple at a bluff 6 poles from the original corner two black oaks one of them marked D then with the original line N 50 W 138 po- to three post oaks then with another of the old lines N 30 E 177 po- to two post oaks & black oak thence a division line S 5 W 194 po- to the beginning to have and to hold the aforesaid tract of land with its appurtenances to her the Said Nancy C. Hurt her heirs forever and the Said G. W. Hardiman for Himself his heirs Executors adminis- and assigns Doth hereby covenant and agree to and with the Said N. C. Hurt that he the Said G. W. Hardiman will warrant and forever Defend the aforesaid tract or parcle of land to her the Said Nancy C. Hurt her heirs and against the claim or claims of himself his heirs and all persons claiming by through & under him or them and against the claim or claims of all persons whatsoever. This Deed of Mortgage made and entered into this Augst 25th 1867. Nancy C. Hurt & her husband F. A. Hurt of the first part, and John R. Johnson of the second part, both parties of Christian County KY Witnesseth that the said Nancy C. Hurt & F. A. Hurt stands justly indebted to the part of the second part in the sum of $121.00 by note this day executed due one day after -?- by said first party & wishing to secure the said 2nd party from any loss by reason of such indebtedness. And for the consideration of the sum of $121.00 by note this day executes as aforesaid have this day and doth by presents sell and place in mortgage into the 2nd party certain piece or parcel of land lying & being in Christian County State of KY on its waters of Tradewater con— 100 acres, & being the same land conveyed to the said Nancy C. Hurt by G. W. Hardiman & for a more particular descriptive reference is hereby made tosf—deed recorded in deed book No. 44 page 457. To have and to hold same & the appurtenances thereunto belonging unto the party of the second part his heirs and assigns forever. But – distinctly am clearly understood that should the party of the 1st part pay or cause to be paid the afsd. consideration of a note of $121.00 & all interest accruing thereon 12 months from the date thereof, then this deed of mortgage take null and void so for effect, otherwise to remain full force & effect This Augst 25th 1868. DEED: Pennington to Moses HURT

This indenture made this ninth day of January in year of our Lord One thousand eight hundred and forty four, Between Frances P. Pennington and Rachael Pennington his wife of the state of Kentucky and County of Christian in the one part and Moses Hurt of the other part and state aforesaid of the other part. Witnesseth that the said Frances P. Pennington for and in consideration of the sum of six hundred dollars unto his hand paid the receipt whereof is hereby acknowledged both granted bargained and sold and by these presents doth grant bargain and sell unto the said Moses Hurt and his heirs and assigns all that tract or parcel of land situated in the Counties of Christian and Todd on the Waters of Pond River and Bounded as follows (to viz), Beginning at a Black Oak corner in Joel Hails line thence S 36 W 23 poles to two black oaks near a drean (drain?) Thence up the drean N 78 W 160 poles to two black oaks on a ridge or rise thence N 6 W 84 poles to a post oak and small forked sugar tree crossing a spring branch at 42 poles thence with a line of a 150 acre survey made for Samuel Parks East 28 poles to an Elm and Sugar tree on the west bank of a branch, Thence N 10 E 20 poles to two post oaks, thence N 61 ½ (?) E 196 poles to a beach Sugar tree White Oak and ash on the bank of the East fork of Pond River, Thence S 28 E148 poles to a sugar tree and beach On the bank of a branch thence S 80 W 123 poles to the Beginning Containing two hundred and thirty three acres be the Same More or less together With all, I the Said Frances P. Pennington will Warrant and ever defend unto the Said Hurt his heirs and assigns against the claims of all persons or to claim by through or under him the Said F.P. Pennington his heirs Executors administrators or assigns or through or by any other person or persons or any other manner whatever, In Testimony whereof we have hereunto Set Our hands & Seal this the day and above written.

Pennington by the oath of John S. Spurlin a Subscribing Witness thereto and on the 11th day of July 1844 the said deed was in like manner proved to be the act and deed of the said Frances P. Pennington by the oath of William C. Spurlin another subscribing witness thereto and ordered to be recorded whereupon the said deed together with the foregoing Certificate hath been duly admitted to record in my office, Given under my hand the 11 day of July 1844. ********Later entry in Christian Co., KY Deed book 32, page 150, has Rachael Pennington coming in to court and for $1.00 she gave her okay to this deed listed above on 29 March 1849 as she did not sign earlier even though the document had her listed.. Nancy M. (her X mark) Hurt and Abram Stites, clerk, signed as witnesses. (Nancy M. Hurt was Nancy Mariah Hurt, daughter of Moses Hurt.)
