This Indenture made and entered into this 25th day of August 1873 between Jesse Stone Admin,, of the estate of Wm. W. Hurt dec’d, W.B. Hurt, Willis Stone, Louisa Stone his wife, Birgis Hurt, Jefferson Walls, Cytha Walls, his wife, Jno Grant, Sarah M. Grant, his wife, Sam’l N. Davis, W. B. Davis, Charles David, Sarah A. David, his wife, Francis M. Hurt, Olvier M. Hurt, Albert H Rowe, Elizabeth E Rowe his wife, Martha L Hurt, D.B. Bryant, Laura A Bryant his wife, Josiah Hunter and all creditors who have presneted thier claims in the settlement of the estate of said Wm. W. Hurt Dec’d. by J.W. Butler comes in Equity of the first part and Charles Callison of Adiar County Ky of the Second aprt, witness the —- at the Feby term 1872 of the Adair Circuit Court in the case of Wm. M Hurts Admn Plaff against Wml W Hurts heirs to defgts. It was ordered and adjudged by the court that the tract of land mentioned and described in the pleadings and title bond from deft Hunte’s to decedent lying in Adair County on the waters of Petits fork containing one hundred and seven sacres be sold to the highest bider and credit of six and twelve months and Robert Millaer master coms. was directed to make said sale at the late residence of decendent. Said Miller comes having filed this report of Sale at the Aug. term 1872 of said court by which it affirms that he did after advertising the land for sale as by the judgement directed on Friday the 15th day of March 1872 on the premises make said sale at public auction to the highest bidder and Charles Cullison being the hgihest bidder the said land was sold to him at his the highest bid of nine hudnredn and twenty five dollars and fifty cents, on a credit of six and twelve months, the report of sale has been approved and confired by the court and the purchase money paid. J.W. Butler was appointed a coms. at the present term of said court to comvey to the purchasere, now therefore for & in consideration of the promises and by the virtue of the said Butler vested as coms. afore said for & on behalf of the parties of the first part does nereby give grant bargain transfer and convey unto the said Charles Cullison his heris and assign forever said tract of land situate lying and being in Adair County on the waters of Petits fork containing one hundred and seven acres being the same tract of land said Wm. W. Hurt got from his father William Hurt —? out of which said decedent sold Robt Allen seventy acres as aforesaid to have and to hold the said tract of land with all the opportunities there undo belonging unto the said Charles allison his heris an dassings forever and siad Butler Coms. as aforesaid for and on behalf of the parties of the first part convenant and agree to warrant the title to the property hereby conveyed against all claims whatever to the extent of their respective interest therein. At a circuit court convened and held for the county of Adair at the courthouse in Columbia on Monday the 25th day of August 1873, the foregoing deed of conveyance from J.W. Buttler commissioner in Equipty to Charels Callison was this day —? in open court and acknoweldged by said comes to be his act and deed which being examiend was apporved by the court and so endorsed to be certified for record as required by law which is done accordingly. attest Jamd T.
