Will of Thomas Thorne, Rutherford County, Tennessee
I Thomas Thorne being of sound mind and perfect mind and memory do make and publish this my last will and in manner and form as follows.
First, I desire that all my funeral expenses and all my just debts be paid as soon after my death as possible, out of any money that I may be dispossessed of or may come first into the hands of my executors.
Secondly: I give and bequeath unto my son William Thorne my home plantation and the lines to run as follows, Beginning at a cedar standing on the north banks of Stone River, it being my south east corner, thence running north from said corner sixty four poles to a cedar marked as a corner. Also with two letters T.T., thence south 26/2 degrees, west ninety poles to the center of the well, thence north 5 degrees, west sixty poles to a poplar, thence north 28 degrees, west seventy three poles to an oak on Levi Lannons east boundry line, thence south with said line to the river, thence up said river with its meadows to the beginning.
Thirdly; I will and devise that after my death that there be a line run through the balance of my land, beginning at a poplar and cedar which is marked as a corner standing on the line running from the cedar with two “tees” to the weld, thence running from said poplar and cedar north, one hundred and ten poles to a post oak. It being the south east corner of a fifty acre tract of land deed to me by William Nash, thence running from said post oak corner and north west corner to the north west corner of said fifty acre tract of land.
I then will and direct that my son Thomas Thorne is to have all my land lying south west of the last named line and my son Andrew Thorne and daughter Jane Underwood is to have all my land lying northeast of the last named line, and it being equally divided between Andrew and Jane according to the quality and quantity and the house that Jane now lives in is to be her own property. and I further ordain that my son William Thorne pay to my granddaughter Lucy Ann Eliot ten dollars in good money.
I give to my daughter Rachel Cunningham and James Cunningham, her husband one note of land that I now hold signed by the said James Cunningham-for thirty six dollars and some cents, for their share of my estate in full and that they come in for no other part of my estate.
I now give to my son James Thorne one bed and furniture and one sorrel horse, five years old and also appoint my son William Thorne agent for said James, and if said William should die before the said James, I then appoint my son Thomas Thorne agent for the said James. And whichever of them are acting as agent at his death is to have the property belonging to him at that time, and after my death I give to my son William Thorne my bed and furniture and I further ordain after my death my executors sell the balance of my personal estate, including all cash or debts owing to me at that time and equally divide it between my son John Thorne, Thomas Thorne, and my daughters to wit Elizabeth Lannon, Susan Lowery, Sarah Wallace-giving Jane Underwood half a share of my personal property with her other sisters and two brothers last named, and lastly I appoint my two sons William Thorne and Thomas Thorne executors to this my last will and Testament, hereby revoking all former wills made by me at any time made in witness, where of I set my hand and affix my seal this 18th day of January 1845.
